February 5, 2014 was the day we thought we would never see. It was the day the Canadian government announced it had caved to a foreign nation’s demands to invade our honest, law abiding lives as Canadian citizens and residents to seize our private and legal financial records. It was the day we learned the Canadian government considers us second class Canadians with limited rights under Canadian laws and Canada’s Charter of Rights and Freedoms.
Today is the day we begin our drive to fight back. February 28, 2014 is the day we launch our Canadian Charter Challenge Fund to raise money for a legal opinion from prominent constitutional lawyer, Joseph Arvay.
We must demand freedom. We must demand our government uphold our rights. We must demand the government place its citizens and residents over the demands of a foreign power.
We must demand our government place our rights over those of the bully oppressor. We must band together to fight for our cherished Canadian rights and freedoms. We must do it now.
Remember, the War of 1812 was not over until 1815. We should likewise expect our battle to be long, brutal and costly

Wow. this is great ! Most Americans do not know or understand this law. They thought it is about fighting FAT CAT. It is about big government over reaching.
Main stream papers, TV and radio in USA do not talk about this law at all.

@Kong: You are absolutely correct. James Jatras calls FATCA “the worst law most Americans have never heard of.”
Unfortunately, it’s the same around the world. Governments are surrendering their sovereignty, laws and constitutions for a foreign bully while keeping their citizens in the dark.
I hope you will consider donating to our Charter Challenge Fund. We are not FAT CATs. We are ordinary people of modest means living honest, productive lives in our countries of choice and citizenship while our personal integrity and financial lives are under attack by the Americans.

Suggestion to anybody in the forum who donates.
If you report any unincorporated self-employed or investment income (i.e., not including dividend or wage income derived from a private corporation of which you are an owner), I suggest you write your donation off as a legal expense. It is admittedly, a bit aggressive, but tax preparers I know mostly agree that it is at least defensible and arguable. As is often the case when claiming any write off on business or investment income, it not so much what is absolutely right or wrong, but whether you have an arguable position.
My argument is this. It is a necessary legal expense because you need to be able to go about your business affairs in an orderly manner without interference from a foreign power (or a weak-kneed Canadian government). That outside interference hinders your ability to make income because it takes up so much of your time.
The reason I draw a distinction between unincorporated income and income from a self-owned corporation is that if the expense is disallowed in the corporation, it can be added back to both the corporate income and to the shareholder’s personal income as a taxable benefit. If it is disallowed on your personal return, it is merely added back to your personal income from where you deducted it in the first place.
If your report any significant amount of investment income on your personal return, I would suggest writing it off as a carrying cost. After all, you are protecting your investments.
I will donate, and speaking for myself, I will claim it as a legal expense on my personal 2014 tax return that I file one year from now. If it is disallowed, I will file a notice of objection, and fight it at least until the appeals stage.
Talk with your tax preparer, and discuss arguments as they apply to your situation on why it should be deductible. I have discussed it already.

I have no idea if your suggestion of claiming this as a tax deduction is acceptable. I do know we do not have charitable status and understand we would not qualify for such even if we applied.
We certainly do not want to do anything to encourage anyone to do anything that is illegal or inappropriate. I personally would check with a professional before I would undertake your suggestion–but I file only as an individual and not as a unincorporated self-employed, so it’s totally academic for me.
